The short version
- Advocato is a CRM with a built-in referral engine, operated by VIGOR Digital Solution Sdn. Bhd., a Malaysian private limited company.
- You're responsible for the data you upload and the rewards you owe your referrers. We're not the payment processor; we don't move money between you and your referrers.
- Don't game the system. No self-referrals, no fake leads, no fabricated closed deals to inflate rewards.
- If something goes wrong, our liability is capped at the greater of (i) what you paid us in the 12 months before the incident, or (ii) MYR 500.
- Malaysian law governs these Terms; disputes go to the courts of Kuala Lumpur.
1. Who's who
These Terms of Service (the “Terms”) form a binding agreement between VIGOR Digital Solution Sdn. Bhd.(“Advocato,” “we,” “us,” “our”), a private limited company incorporated in Malaysia, and you — the individual or organisation accessing the Advocato service available at advocatto.com and related subdomains (the “Service”). By signing up or otherwise using the Service, you accept these Terms. If you don't agree, don't use the Service.
2. The Service
Advocato is a software-as-a-service product that lets businesses (“Providers”) manage their sales pipeline, generate shareable referral links, capture leads, schedule appointments, and configure referral rewards for individuals who refer customers (“Referrers”). End customers (“Customers”) submit enquiries through referral landing pages or embedded forms.
We may add, change, or remove features. We aim to provide notice of material removals where reasonably possible.
3. Accounts
- You must provide accurate registration information and keep it current.
- You're responsible for the confidentiality of your credentials and for activity that happens under your account. Notify us immediately at security@advocatto.com if you suspect unauthorised access.
- One account per individual. Workspace owners may invite team members and assign roles (owner, admin, agent, referrer).
- You must be at least 18 years old (or the age of majority in your jurisdiction) to hold an Advocato account.
4. Your content and your role
You retain ownership of all data you upload or generate in the Service (“Your Content”), including products, referral links, leads, deals, appointments, and notes.
You grant Advocato a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display, and otherwise process Your Content solely to provide the Service to you and your authorised users. This licence ends when you delete the content (or your account), subject to the retention periods in our Privacy Policy.
You represent that you have all rights necessary to upload Your Content and to share lead contact details with us, and that doing so does not violate the privacy or other legal rights of any third party. You are the data controller for Customer and Referrer personal data uploaded into your workspace; we process it on your behalf.
5. Acceptable use
You agree not to:
- Game referrals. No self-referrals, no creating fictitious referrers to claim your own rewards, no fabricating closed deals to inflate rewards, no colluding with another party to do any of the foregoing.
- Spam or mass-message via the referral or notification features. All transactional emails must be triggered by a real user action.
- Upload personal data without lawful basis. Don't import contact lists you don't have permission to use.
- Reverse-engineer, decompile, scrape, or attempt to disrupt the Service, its security mechanisms, or its underlying infrastructure.
- Use the Service for unlawful or harmful purposes, including any use that violates Malaysian export controls, sanctions, or other applicable laws.
- Resell, white-label, or sublicense the Service without a separate written agreement with us.
We may suspend or terminate an account that, in our reasonable judgment, violates this section. Where appropriate we will give you notice and an opportunity to cure first.
6. Plans and payment
The Service is currently offered free of charge during early access. We will give at least 30 days' notice before introducing paid plans, and existing workspaces will be offered a fair transition path.
When paid plans launch, fees will be displayed in the application before you commit to them and may be charged in advance on a recurring basis. Taxes (including Malaysian Sales & Service Tax where applicable) will be added at checkout.
7. Referral rewards — Advocato is not a payment processor
This section is important. When a Provider configures a reward on a product (a cash amount, a percentage, an in-kind benefit, etc.) and a Referrer's referral leads to a closed deal, Advocato records that reward in the Provider's pipeline.
- Advocato does not hold or transmit money between Providers and Referrers. We are not a money-services business, an e-money issuer, a remittance agent, or an escrow service under Malaysian or any other law.
- The Provider is solely responsible for paying the Referrer the reward outside of Advocato (by bank transfer, voucher, in-kind, etc.), for withholding any applicable taxes, and for any reporting obligations to tax or regulatory authorities.
- Advocato is not a party to the referral arrangement between a Provider and a Referrer. Disputes about whether a referral was valid, whether a deal closed, or whether a reward is owed are between the Provider and the Referrer to resolve.
- Referrers should review the reward terms displayed by the Provider on a referral link before sharing it. By sharing a referral link, the Referrer acknowledges these arrangements.
8. Customer privacy and your obligations
When a Customer submits a lead through a referral link or embedded form, the data becomes part of Your Content. As the data controller, you must:
- Provide your own privacy notice to the Customer (Advocato's site notice is supplied for our Service, not your business).
- Honour data-subject access, correction, and deletion requests from your Customers and Referrers within the timeframes required by applicable law (under PDPA s.30(2), 21 days).
- Not use the data for purposes the Customer or Referrer would not reasonably expect.
We will, where reasonably possible, support you with tools and processes (data export, deletion, audit logs). See the Privacy Policy for details.
9. Intellectual property
All right, title and interest in and to the Service, including all underlying software, designs, trademarks, and the “Advocato” mark, are and remain the property of Advocato and its licensors. Nothing in these Terms transfers any intellectual property rights to you, except the limited right to use the Service described here.
You may share feedback, ideas, or suggestions about the Service. You agree we may use them without obligation or compensation.
10. Termination and data export
You may stop using the Service at any time. To close your account, use /app/settings/privacy. Your account is soft-deleted immediately and your data permanently destroyed after a 30-day grace period.
You can export Your Content at any time from /app/settings/privacy → Download my data. We recommend you do so before deleting your workspace.
We may suspend or terminate your access immediately and without refund if you breach §5 (Acceptable Use), if continued provision of the Service is required by law to stop, or if your account creates a security or legal risk to us or our other users. For other terminations, we will give you reasonable advance notice.
11. Service availability — as is
We work hard to keep the Service running, but we provide it “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't guarantee that the Service will be uninterrupted, error-free, or that it will meet your specific business requirements.
Scheduled maintenance and incident reports are communicated by email to workspace owners and posted on a public status channel where one is available.
12. Limitation of liability
To the maximum extent permitted by Malaysian law:
- Cap. Our total aggregate liability under or in connection with these Terms or the Service, however arising (contract, tort, statute, or otherwise), in any rolling 12-month period, is capped at the greater of (i) the amount you paid Advocato for the Service in the 12 months preceding the event giving rise to the claim, or (ii) MYR 500.
- Excluded damages. We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, anticipated savings, or data, even if we have been advised of the possibility.
- Carve-outs. The cap and excluded damages do not apply to (a) our gross negligence or wilful misconduct, (b) our indemnification obligations in §13, or (c) liability that cannot be limited or excluded under applicable law.
13. Indemnification
You agree to indemnify and hold Advocato and its officers, directors, employees, and agents harmless from and against any third-party claim, damage, loss, liability, or expense (including reasonable legal fees) arising out of (a) Your Content, (b) your use of the Service in violation of these Terms or applicable law, (c) your referral-reward obligations to Referrers, or (d) any privacy or data-protection claim arising from how you handle Customer or Referrer data.
We will promptly notify you of any such claim, give you reasonable cooperation, and allow you to control the defence and settlement (provided that no settlement may admit liability on our behalf or impose obligations on us without our consent, not to be unreasonably withheld).
14. Confidentiality
Each party may receive information from the other that is non-public and identified as confidential or that should reasonably be understood as such (“Confidential Information”). The receiving party will protect the other's Confidential Information with at least the same care it uses to protect its own (and not less than reasonable care), and will use it only to perform under these Terms.
15. Changes to these Terms
We may update these Terms from time to time. Non-material updates take effect on posting. Material changes will be announced by in-app notification or email at least 14 days before they take effect. Your continued use of the Service after the change date constitutes acceptance. If you don't agree, you can stop using the Service and delete your account before the change takes effect — your data will be removed under the 30-day grace policy.
16. Governing law and disputes
These Terms are governed by the laws of Malaysia, without regard to its conflict-of-laws principles. Any dispute will be brought exclusively in the courts of Kuala Lumpur, and each party submits to their personal jurisdiction.
Before commencing formal proceedings, the parties will attempt in good faith to resolve the dispute by direct discussion. If the parties cannot resolve it within 30 days, either party may seek mediation through the Asian International Arbitration Centre (AIAC) before resorting to court.
Consumer protections under the Consumer Protection Act 1999 (Malaysia) or your local law that you cannot waive by agreement remain in effect.
17. Miscellaneous
- Entire agreement. These Terms and the documents they reference are the entire agreement between you and Advocato regarding the Service.
- Severability. If any provision is unenforceable, the remainder stays in effect.
- No waiver. A delay or failure to enforce a right is not a waiver of that right.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of substantially all our assets, on notice to you.
- Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control (natural disasters, war, civil unrest, major internet or utility outages, government action).
- Notices. We may send you notices to the email associated with your account or by in-app notification. Notices to us go to legal@advocatto.com.
